Who is responsible

The controller for processing your data on wels.immobilien is CE Immo Group GmbH, Ringstraße 28, 4600 Wels, Austria. You can reach us at info@wels.immobilien. Further details are in the imprint.

Visiting the site

When you visit wels.immobilien, the server processes the technically necessary data: IP address, time, requested address, browser and operating system. We need it to deliver the site and protect it against attacks (Art. 6(1)(f) GDPR). The site is hosted by easyname GmbH in Vienna, which acts as our processor and whose mail server we also use to send our emails. We only analyse the server's access logs in case of faults or attacks.

We do not use any advertising or analytics services. Fonts and map software are served from our own server.

Emails to our office

Our office mailbox runs on Google Workspace of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, acting as our processor. It receives emails you send to info@wels.immobilien, applications from agents, notices of new reports (without your details) and unsubscriptions from search alerts. Google may transfer data to the USA, which is covered by the European Commission's adequacy decision on the EU-US Data Privacy Framework (Art. 45 GDPR). We delete completed emails there under the same time limits as in this policy.

Cookies

wels.immobilien only sets cookies that are necessary for operating the site. No consent is required for these (§ 165(3) TKG 2021).

Map

Your browser loads the map tiles directly from the basemap.at server (mapsneu.wien.gv.at, run by the City of Vienna for the Austrian federal states). That server receives your IP address. This is necessary to display the map (Art. 6(1)(f) GDPR).

Account and sign-in

For an account we need your email address and your language. You sign in with a link we email to you, valid for 30 minutes. There is no password; of the link and the session we only store check values (hashes). The purpose is to let you manage your listings and read enquiries (Art. 6(1)(b) GDPR).

To stop anyone requesting links in bulk, we store the IP address. We delete sign-in links after 7 days, expired sessions in the next clean-up run and the IP address of an active session after 7 days. Your account remains until you ask us to delete it.

Sign in with Google

If you choose "Sign in with Google", the site redirects you to Google. Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, then sends us your email address and an identifier. We never see your Google password. Google may transfer data to the USA, which is covered by the European Commission's adequacy decision on the EU-US Data Privacy Framework (Art. 45 GDPR). The legal basis is that you choose this sign-in (Art. 6(1)(b) GDPR).

Sign in with Facebook

If you choose "Sign in with Facebook", the site redirects you to Facebook. Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland, then sends us an identifier and, if you allow it, your email address. We never see your Facebook password. Meta may transfer data to the USA, which is covered by the European Commission's adequacy decision on the EU-US Data Privacy Framework (Art. 45 GDPR). The legal basis is that you choose this sign-in (Art. 6(1)(b) GDPR).

Listings and photos

When you post a listing, we store the details of the property, the photos, your phone number and the link to your account. The listing is public, including your phone number and email address, so that people can reach you directly. We also forward enquiries sent through the form. We only show the exact address if you choose to. We resize photos and save them anew, which removes camera and location data (GPS). The legal basis is the contract for using the portal (Art. 6(1)(b) GDPR).

We delete a draft started without an account, including its photos and the email address for the confirmation link and the IP address against abuse, after 7 days. When you delete a listing, we remove the photos immediately. We keep the other details and the history for questions and reports for another 12 months and then delete them. A listing you only take offline stays in your account until you delete it.

Checks before publishing

Before a private listing goes online, we check it automatically for signs of fraud, for links and email addresses in the text and for unusual prices. If the check finds something, a member of staff reviews the listing and decides. There are no decisions made by the machine alone. The legal basis is our legitimate interest in a safe portal (Art. 6(1)(f) GDPR).

Photos are also checked by the Sightengine service of Kozelo SAS, France, acting as our processor: for nudity, violence, weapons and text in the image such as phone numbers. Each photo is sent to Sightengine once for this. We only store the result. Sightengine may use data centres in the USA and Canada. The transfer is covered by the adequacy decision on the EU-US Data Privacy Framework or for Canada (Art. 45 GDPR) and by standard contractual clauses (Art. 46 GDPR).

Exchange with nomak.at

nomak.at is also operated by us. Private listings for flats, houses and plots, including successor tenant listings, also appear on nomak.at; rooms in shared flats do not. The property details and photos go to nomak.at, your contact details do not. In turn, we show private listings from nomak.at for Wels and Wels-Land here. The legal basis is the contract for using the portal (Art. 6(1)(b) GDPR).

Agents

Agents who list here provide their company, contact person, email address, phone number, website, GISA number and professional title when registering and can upload a logo. We show the company, contact details, website and logo with their listings. They deliver their listings via the OpenImmo interface. The legal basis is the contract for using the portal (Art. 6(1)(b) GDPR).

Enquiries about a listing

If you contact an advertiser through the form, we pass on your name, email address, phone number (if given) and message. The advertiser can reply to you directly and is responsible for further contact. The legal basis is your enquiry (Art. 6(1)(b) GDPR). We store the enquiry for 12 months so the advertiser can see it in their account, and the IP address for 7 days to prevent abuse.

Search alert

For a search alert we store your email address, your search and the wording of your consent. Only after you confirm the link in our email do we send you matching new listings (Art. 6(1)(a) GDPR). We delete unconfirmed search alerts after 7 days and the IP address after 7 days. You can unsubscribe using the link in every email. We then keep the email address, the wording of the consent and the timestamps as proof for 3 years and delete everything else.

Reports

Anyone can report a listing via "Report this listing" (Art. 16 DSA). We store the reason and explanation, optionally your name and email address, and the IP address for 7 days. If you give an email address, we confirm receipt and tell you our decision. If we remove a listing, the advertiser learns the reason but not who reported it. We delete completed reports after 12 months. The legal basis is our obligation under the Digital Services Act (Art. 6(1)(c) GDPR).

Your rights

You have the right to access, rectification and erasure of your data, to restriction of processing, to data portability and to object to processing based on our legitimate interest (Art. 15 to 21 GDPR). You can withdraw consent at any time; processing up to that point remains lawful. Write to us at info@wels.immobilien.

You can lodge a complaint with the data protection authority (Art. 77 GDPR, § 24 DSG): Österreichische Datenschutzbehörde, Barichgasse 40-42, 1030 Vienna, www.dsb.gv.at.

Do you have to provide data?

Without an email address we cannot create an account, forward an enquiry or send a search alert. Beyond that, the law does not require you to provide any data.
