What this is about

wels.immobilien is a portal for property in Wels and the Wels-Land district. Private owners and agents publish listings here; people searching find them on the map and contact the advertiser directly. The operator is the company named in the imprint. Posting listings and searching are free of charge.

Who may post listings

A listing must concern a property in Wels or a municipality of the Wels-Land district. A private account can have at most 10 listings online or under review at the same time and create at most 5 new ones per day. Each listing can have up to 20 photos.

What a listing must contain

What is not allowed

Contact in the listing

Your listing shows your phone number and email address so that people can reach you directly. Only give a number where you yourself can be reached.

Photos and texts

You confirm that you hold the rights to your photos and texts and that people shown in them have agreed. You allow us to show photos and texts on wels.immobilien for the duration of the listing and to pass them on to nomak.at, to resize and crop the photos for this purpose. The rights remain with you. The permission ends when you delete the listing.

Also on nomak.at

Private listings for flats, houses and plots, including successor tenant listings, also appear on nomak.at. Rooms in shared flats do not. We do not pass on your contact details. If you take the listing offline or delete it here, it also disappears there.

How we check listings

We check every private listing automatically before it is published: for patterns of fraud, for links and email addresses in the text, for unlawful transfer fees and for unusually low prices per square metre. Photos are checked automatically by the Sightengine service for nudity, violence, weapons and text in the image. If nothing is found, the listing goes online immediately and a member of staff reviews it on the next working day. If something is found, it waits until a member of staff has decided. Decisions are always made by a person.

If a listing breaches these terms or the law, we can hold it back, reject or remove it, and block an advertiser who breaches them repeatedly or seriously. We explain every such decision to you by email: what we did, why, which rule we rely on and whether an automatic check triggered it (Art. 17 DSA). If you disagree, reply to that email and a member of staff will review the decision again. You can also turn to an out-of-court dispute settlement body or a court.

Reporting listings

If you think a listing is unlawful, fraudulent or false, use the "Report this listing" link on the listing (Art. 16 DSA). State what it is about and why, and confirm that you are reporting in good faith. Name and email address are optional. If you give an email address, we confirm receipt and tell you our decision. The advertiser is not told who reported the listing.

Responsibility

Contracts about a property are concluded only between the advertiser and the interested party; we are not a party to them. The advertiser is responsible for the content of a listing. We check listings as described above but cannot verify every detail. View a property before you pay anything.

We are liable in accordance with the law. We are not liable for slight negligence, except for personal injury.

Ending your account

You can take your listings offline or delete them at any time. If you want your account deleted, write to info@wels.immobilien. We can end the use of the portal if someone repeatedly or seriously breaches these terms.

Changes

If these terms change, the new version applies to listings posted or changed afterwards. We inform all account holders of significant changes by email.

Law and jurisdiction

Austrian law applies. Mandatory consumer protection rules remain unaffected. A consumer whose residence or habitual abode is in Austria, or who is employed here, can only be sued at one of these places (§ 14 KSchG).

Point of contact

Single point of contact under Art. 11 and 12 of the Digital Services Act, for authorities and users alike: info@wels.immobilien. You can reach us in German and English.
